ABOUT

On September 5, 2014, Robert Muhammad went on an outing with eight co-workers.  Seven of the co-workers were drinking multiple beers that day. At some point during the outing, Mr. Muhammad and the seven co-workers boarded a sailboat belonging to Bertrand Thibault.  Mr. Muhammad was uninjured when he boarded the sailboat.

At some point, while on the boat, it is likely that the co-workers then assaulted and battered Mr. Muhammad which caused significant injuries to his face. Mr. Muhammad had “contusions of the left suprabrow area and lateral upper and lower eyelids, an elevated subconjunctival hemorrhage of the left eye with a large corneal abrasion, partial thickness skin abrasions of the lateral brow area and upper and lower eyelids and a laceration and contusion of the left side of the lower lip.” The abrasions on Mr. Muhammad’s forehead and the swelling of his lip indicated that he was alive when he received these injuries. Mr. Muhammad’s injuries “are unusual for drowning cases.”  Mr. Muhammad’s facial and periocular injuries “are attributable to blunt force trauma …[such as] being struck with a fist or blunt objects such as a stick[.]”  As a result of the trauma inflicted upon Mr. Muhammad by co-workers, it is likely that Mr. Muhammad became unconscious, “fell overboard” into Muskegon Lake and “never resurfaced”.

In the alternative, it is likely that the co-workers assaulted and battered Mr. Muhammad causing the above-mentioned injuries, then the co-workers caused Robert Muhammad’s body to be dumped in Muskegon Lake “less than 4 hours before recovery”.
